Terms of Use

1. Purpose

These Terms of Use govern the use of the Taka mobile application ("the Application") and its associated online services ("the Service"), published by DUCLOTDEV, a French simplified joint-stock company with a sole shareholder (SASU) with share capital of EUR 100, whose registered office is at 1 Allée des Hêtres, 74600 Annecy, France, registered with the Annecy Trade and Companies Register under number 108 739 459, represented by its President Mr Aymeric Duclot ("the Publisher"). By installing or using the Application, you accept these Terms. If you do not accept them, do not use the Application.

2. Description of the service

Taka is a leisure application for organising games of "free-range footgolf": a ball-precision game played on improvised targets, between friends. The Application lets you keep score, apply the rules of the game (including the "Call" mechanic), run leagues and rankings, record symbolic forfeits ("ardoises"), follow daily challenges, track your progression and statistics, connect with other players (friends, invitations, reactions) and, if you choose to enable it, find players nearby.

The Application works with a user account and a server: your matches, progression and friend connections are saved to your account so they carry over between devices. Matches can be played and recorded offline, then synced to your account once you are back online.

3. Account, guest mode and age

You can create an account with an e-mail address (single-use verification code), with Sign in with Apple or with Google. A "guest mode" lets you try the Application without providing an e-mail address; some social features (such as finding players nearby) however require a full account.

You agree to provide accurate information and not to impersonate anyone. You are responsible for keeping access to your account confidential and for the activity carried out from it.

Use of the online features (account, social features, geolocation) is reserved for people aged 15 and over, or under 15 with the joint consent of the holders of parental responsibility, in accordance with Article 45 of the French Data Protection Act.

4. Free of charge and paid options

The base version of the Application is provided free of charge and without advertising. It requires a compatible iOS or Android device; connection and equipment costs remain the user's responsibility. The Publisher may later offer an optional paid tier ("Taka Pro") whose conditions (price, content, cancellation) will be presented before any subscription and governed by the app store terms (Apple App Store, Google Play).

5. The physical game: caution and responsibility

Taka accompanies an outdoor or indoor physical activity practised under the players' sole responsibility. By using the Application, you agree to:

  • play in places where the game is allowed and safe for you, third parties and property (no balls near roads, windows or vulnerable people);
  • respect the rules of parks and public spaces;
  • adapt the intensity of play to your physical condition.

6. Forfeits ("ardoises"): symbolic only

The forfeit feature is strictly symbolic and friendly (e.g. carrying a bag, buying a round). It in no way constitutes a betting or gambling system. It is forbidden to use the Application to organise bets involving money or items of value. "Ardoises" have no legal value; honouring them relies solely on the players' good faith, and the Publisher plays no part in settling them.

7. User conduct and content

The user agrees not to: use the Application for unlawful purposes; publish content (nickname, username, bio, profile photo, match or league names) that is abusive, defamatory, hateful, sexual in nature or infringes third-party rights; harass other players; attempt to interfere with the operation of the Application or the Service (reverse engineering outside legal exceptions, circumventing technical measures, manipulating scores or rankings).

Blocking and reporting tools are available in the Application. The Publisher may remove content that is manifestly unlawful or contrary to these Terms and, in the event of serious or repeated breaches, suspend or delete the account concerned, in compliance with the applicable rules (notification and means of redress).

8. Intellectual property

The Application, its brand, logo, texts, interface and presentation mechanics are protected by intellectual property law and remain the exclusive property of the Publisher or its licensors. Using the Application confers no ownership rights. Any unauthorised reproduction or exploitation is prohibited.

Content provided by the user (nickname, profile photo, match names) remains the user's property. The user grants the Publisher a limited, non-exclusive, royalty-free licence to host and display this content to the other players concerned (team-mates, friends, members of the same league), solely to the extent necessary to operate the Service.

9. Availability, offline play and evolution

The Application is provided "as is". The Publisher strives to keep it working properly but guarantees neither the absence of errors nor uninterrupted availability of the Service. The Publisher may evolve, suspend or discontinue all or part of the features.

Matches recorded offline are kept on your device until they are synced to your account. Until a match has been synced, its loss (uninstalling the Application, device failure) cannot be compensated by the Publisher.

10. Deleting your account

You can delete your account at any time from the Application (Settings → Privacy). Deletion takes effect after a short grace period during which it can be cancelled by signing back in; once the period ends, it is permanent. Scorecards of matches played with other players are kept in anonymised form ("deleted player"), because they are also those other players' history. The details are set out in the Privacy Policy.

11. Publisher's liability

To the extent permitted by law, the Publisher's liability is limited to proven direct damages resulting from its fault, and excludes indirect damages (including loss of unsynced data and emotional distress caused by a footgolf defeat — humorous clause to be removed by the lawyer if necessary). Nothing in these Terms excludes the Publisher's liability in the event of fraud, gross negligence or bodily harm caused by its negligence.

12. Changes to the Terms

The Publisher may modify these Terms. Any substantial change will be brought to the user's attention in the Application before it takes effect. Continued use of the Application after notification constitutes acceptance.

13. Governing law and disputes

These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought first.

In accordance with the French Consumer Code, consumers may use a consumer mediation scheme free of charge. The Publisher's membership of such a scheme is being finalised; the designated mediator's details will be published here and will be provided on request at support@takafg.com.

Failing an amicable settlement, the French courts will have jurisdiction under ordinary law.
